A leaked draft majority opinion of the Supreme Court of the United States shows a Samuel Alito-written opinion that not only intends to completely overturn the precedents set by the court cases Roe v. Wade and Planned Parenthood v. Casey, it specifically leaves the door open for further encroachments on liberties and rights not specifically enumerated in the Constitution by activists who want to use the court to produce a theocracy in their own graven images. Yes, the draft opinion says it's not supposed to be used for anything but abortion, but the logic used in the opinion makes clear its general applicability if it gets used as precedent for other cases, like ones that talk about the right to contraception, or to civil marriage between persons of the same gender, or possibly even civil marriage between persons of different ancestries. There are several reasons to find the draft opinion abhorrent, in terms of law, precedent, and hypocrisy, and the draft opinion, considering the votes for it, could be used, in a context that is not our current one, would be the starting point for considering serious consequences about whether or not the justices misled the questioners about how much respect they would give to precedent regarding Roe.

The leak itself is one of those "this has never happened before" situations for many of the people making commentary, but I can see a very clear reason why it might have been leaked - to give people time to prepare for when the network of trigger laws go into immediate effect on the announcement of the overturning of Roe, as there are several states currently under the control of theocrats posing as politicians who intend quite firmly to ban whatever they can as soon as the Supreme Court gives them leave to do so. Combined with those same theocrats' attempts to prevent the exercise of democracy in their states so that they will never be put out of power unless they are dismissed by an overwhelming dissent of the voters, and the United States seems quite ready to return to previous years where abortion services were conducted clandestinely, not always under the supervision of a doctor, and often with materials that potentially endangered the life of the person aborting, because many of these states also intend for their bans to be blanket, without exception, and therefore will think it perfectly normal to force someone to choose between their chance of dying by being forced to give birth and their chance of dying from attempting an abortion that may or may not be safe. Those with means, of course, will not be required to deal with any of this, as they will simply go wherever the procedure is legal, get the procedure done, and return. It is only those who these self-congratulatory theocrats believe aren't worthy of the title of human being that will have to find their way in the new landscape.

And if those theocrats gain federal power, then they will certainly set to making their theocratic rule apply to all states, blessed by their own court appointees. No more worries about people who could be pregnant holding power over men, no more concerns that a pre-pregnant person might be able to have a life not under the direct control of an approved man.

Many of the supposedly liberal party's federal elected representatives have reacted to this (and all of the other alarming signs about the possible end of the democratic experiment) with all of the urgency of a frog in a slowly-boiling pot, and with likely the same result, rather than engaging in immediate action to destroy those elements of governance put in place so that a super-minority of theocrats and fascists can prevent the operation of the legislative process and the business of government, and then follow that destruction up with unapologetically popular and truly liberal legislation and policies that would at least make a good show of resisting the forces of unfettered capitalism, theocracy, and fascism from taking power and refusing to give it up.

I have no reason to believe that the Court will not do exactly as they have said they would do, and allow for the institution of laws that demand that people who can get pregnant are not allowed to be anything other than pregnant or about to get pregnant.

And so, when that comes to pass, if you really need to get away from it all, I hear that seeing the sights and sounds of the Dragon Conspiracy Territory is a wonderful thing to do. If you wanted to come visit us, we'd do our best to make sure you had a comfortable place to be while you are getting your fill of natural beauty and getting to sample some of the interesting cuisine that's local to the region.
